The European Court of Justice ruled in favor of Turkey's Istanbul Logistics, which sued the Hungarian Customs Directorate.
The Court justified its decision by stating that "to claim tolls on each passage to Hungary, was equivalent to a customs tax, which is contrary to Articles 4 and 5 of the EU-Turkey Partnership Agreement, and therefore inapplicable" .
In March 2015, Hungary had imposed a fine of 2,400 euros on the driver of a Turkish truck because he had not paid the toll of 438 euros. The Turkish company in question, supported by the Turkish National Assembly of exporters, brought the case to Hungary domestic courts.
The latter appealed to the EU Court of Justice, which sought the views of the Member States and the European Commission in January 2016.
The European Commission has voted in favor of Turkey, stating that the toll charges are contrary to the EU-Turkey Partnership Agreement. Moreover, according to the Commission, there is talk of a loss of 3.5 billion euros per month in trade between the EU and Turkey because of these tolls.
